Terms of Use

The use of the services of www.tv-space.com (hereinafter “Space TV”) constitutes acceptance of these Terms. You can view our Privacy Policy here.

Account set-up / Email on file

We will set up your account once payment has been received and we and/or our payment partner(s) have screened the order(s) for fraud. It is your responsibility to provide an email address that is not @ the domain(s) under which you are registering. In case of abuse issues or if we need to contact you, the primary email on record will be used. You must ensure your registered email address is current at all times.

If you have a domain registered with Space TV, you are responsible for ensuring that the contact details for your account and domain name(s) are correct and up to date. Space TV is not responsible for lapsed registrations due to outdated domain contact information. To verify or change these details, contact us by email. Providing false contact information of any kind may result in termination of your account.

For dedicated server purchases or high-risk transactions, a government-issued ID and possibly a scan of the payment card used may be required. Failure to provide these may result in the order being declined as fraudulent.

Transfers

Our support team will make every reasonable effort to help you move your site to us. However, transfers are provided as a courtesy and we cannot guarantee availability, feasibility, or time required. Hosting platforms differ and some store data in proprietary/incompatible formats, which can make migrations difficult or impossible.

Free transfer services are available for 30 days from your sign-up date and only if your previous host uses cPanel. Non-standard control panels may incur migration fees.

Content

All services provided by Space TV may be used for lawful purposes only. The laws of the State of California and of the United States of America apply.

You agree to indemnify and hold Space TV harmless from any claims resulting from your use of our services.

Copyright/trademark infringement is prohibited, including unauthorised copying of music, books, photos or any copyrighted work. Offering counterfeit goods will result in immediate account termination. Material found to infringe will be removed or access disabled; repeat infringement may lead to suspension/termination. To report infringement, contact us with a valid DMCA notice; we may request further proof of licensing where relevant.

Examples of unacceptable material on any hosting plan include (non-exhaustive):

IRC scripts/bots; proxies/anonymisers; pirated software/warez (including links); autosurf/PTC/PTS/PPC/ad-server scripts; IP scanners; brute-force tools; mail bombers/spam scripts; file dump/mirror scripts; commercial audio streaming (more than 1–2 streams); escrow/bank debentures; HYIP/FOREX/e-gold/Ponzi/MLM/pyramid schemes; sale of controlled substances without proper licences; lottery/gambling sites; MUD/RPG/PBBG; hacker-focused sites, archives or tools; sites promoting illegal activities; forums/sites distributing or linking to illegal content; fraudulent sites (e.g., as listed on aa419.org); “Mailer Pro”; live streaming or rebroadcast of sporting events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, etc.); “tell-a-friend” spam scripts.

Unacceptable on dedicated servers also includes: IRCD, IRC bots, pirated software, IP scanners, brute-force tools, spam scripts, escrow/HYIP/FOREX/Ponzi/MLM, sale of controlled substances without licences, lottery/gambling, hacker tools, illegal-content linking, fraudulent sites, Mailer Pro, and live sports rebroadcasts.

Space TV systems (equipment, networks and related devices) are provided only for authorised customer use and may be monitored for any lawful purpose (e.g., system management, security, survivability). During monitoring, information may be examined, recorded, copied and used. Use of Space TV systems constitutes consent to such monitoring.

Any account found accessing a third-party network/system without authorisation is subject to suspension. Access outside your control requires the third party’s express written consent; we may require proof.

We reserve the right to refuse service to anyone. Material deemed obscene, threatening, illegal, or otherwise in breach of these Terms may be removed/disabled with or without notice.

Failure to respond to abuse-desk emails within 48 hours may result in suspension/termination. Abuse matters are handled via ticket/email and answered within 48 hours.

Sites hosted on Space TV are governed only by US law. Under 47 U.S.C. § 230(c) (Communications Decency Act), we do not remove allegedly defamatory content absent a court order finding it defamatory. We are a re-publisher, not the publisher, of third-party content hosted on our services. Upon receipt of a relevant US court order (defamatory/ injunctive), we will disable access to the specified material.

Zero tolerance for harm to minors. Any site hosting or linking to child sexual abuse material will be immediately suspended; repeat reseller violations may lead to termination. Violations will be reported to the FBI.

You are responsible for securing scripts/programs under your account and for proper directory permissions (use 755 or as restrictive as possible). You are ultimately responsible for all actions under your account, including compromised credentials. Strong passwords are required; weak passwords may lead to suspension until changed. We may audit and require updates.

Zero-tolerance spam policy

We operate a zero tolerance stance on unsolicited email, bulk email, and spam. “Safelists” and purchased lists are treated as spam. Offenders will be terminated without refund and without notice—even within the first month.

Sites spamvertised via fax, phone, post, email, IM, usenet, etc., may not be hosted. Entities on ROKSO are prohibited. Accounts causing IP blacklisting may be suspended/terminated immediately.

We may require changes or disable sites/accounts/databases/components that violate policy, and may charge cleanup/blacklist removal fees at our discretion.

Payment information

You agree to provide timely payment in advance for services. Unless you notify us of cancellation, services are billed on a recurring basis.

Cancellations must be made online/by contacting us. You are responsible for keeping billing details current and paying invoices on time. We provide a 14-day grace period from invoice issue; overdue invoices beyond 14 days may incur late fees and/or account suspension until paid in full. Domain renewals are billed/renewed 7 days before renewal date and are non-refundable once processed.

Accounts overdue 30 days may be deleted. Restoration (if backups exist) may incur a $25 fee and prior special pricing will not carry over. Any chargeback will incur a $150 chargeback fee.

Backups & data loss

Use of our backup service is at your own risk. Backups run several times per week, overwriting prior sets; multiple restore points may be kept. This is a courtesy service. Space TV is not responsible for files/data on your account; you must maintain your own backups. Some sites may not generate backups properly due to file permissions; in such cases we are not responsible. We strongly recommend downloading your own backups. We do not guarantee backup integrity.

Cancellations & refunds

We may cancel, suspend or otherwise restrict access at any time, with or without notice. Abuse towards our staff on any medium may result in termination without refund.

Customers may cancel at any time by contacting us. We offer an initial 30-day money-back guarantee on semi-dedicated plans. Dedicated servers have an unconditional 7-day refund window.

The 30-day guarantee applies only to your first 30 days of service and to first-time accounts. No refunds on dedicated servers, admin fees, custom software install fees, dedicated IPs, or domain registrations/renewals. After 30 days, no refunds. PayPal auto-subscriptions must be cancelled by you; we are not responsible for ongoing payments you fail to cancel. Breaches of these Terms void the refund policy.

Resource usage (shared hosting)

Users may not: run unattended server-side daemons; run web spiders/indexers; interface with IRC networks; run BitTorrent trackers/clients (linking to off-site legal torrents is allowed, hosting is not); engage in P2P file-sharing; run game servers; run cron jobs at intervals < 5 minutes; run MySQL queries > 90 seconds (ensure proper indexing); connect to remote databases (programs on shared hosting must use databases on our servers).

Bandwidth usage

You receive a monthly bandwidth allocation depending on your plan. Exceeding it may result in suspension until the next cycle, purchase of additional bandwidth, upgrade, termination, and/or overage charges. Unused transfer does not roll over. New orders/packages will not be activated for customers with outstanding balances.

Uptime guarantee

If your server/hosting experiences physical downtime below 99.99% uptime, you may request one month of credit. Credit approval is at Space TV’s discretion. Third-party monitoring reports are not accepted. Uptime is as reported by the OS/Apache server. Requests must be submitted by email in writing with justification.

Resellers – client responsibility

Resellers must support their own clients. We do not provide support to a reseller’s end-users. If a reseller’s client contacts us, we may suspend the client account until the reseller assumes responsibility. Resellers are responsible for content and actions under their reseller accounts.

Price changes

The amount you pay at purchase will not increase for that term. We may change prices on our site and adjust resource allocations at any time.

Coupons

Discounts/codes are for new accounts/customers only (unless stated otherwise) and cannot be used for domain registrations. Abuse may result in additional billing and/or suspension/termination.

Indemnity

You agree to defend, indemnify and hold harmless Space TV, its agents, clients, officers and employees from any claims, liabilities, losses, costs and expenses (including reasonable legal fees) arising from services provided or products sold by you, including (1) injury to person/property caused by products sold/distributed in connection with Space TV; (2) material supplied by you infringing third-party rights.

Arbitration

By using our services, you agree to binding arbitration. Disputes/claims against Space TV or its affiliates will be handled by an arbitrator selected by Space TV (AAA or NAF) in the State of New Hampshire. Arbitrators will be attorneys or retired judges; decisions are final and binding. The Federal Arbitration Act governs this clause. You are responsible for costs related to arbitration.

Disclaimer

Space TV is not responsible for any business damages. We provide no warranties, express or implied, including merchantability or fitness for a particular purpose. This includes data loss due to delays, non-delivery, mis-delivery, and any service interruptions.

Disclosure to law enforcement

Space TV may disclose subscriber information to law-enforcement agencies without further consent or notice upon lawful request. We fully cooperate with law enforcement.
